Acceptance of Terms

By accessing or using AWRA Logistics services, including our leasing program, dispatch services, and tracking platform, you agree to be bound by these Terms of Service.

These Terms constitute a legally binding agreement between you ("User," "Driver," or "Broker") and AWRA Logistics.

If you do not agree to these Terms, you may not access or use our services.

Use of Services

Service Access

AWRA Logistics provides access to:

  • Contract authority leasing services
  • Dispatch and load coordination services
  • Broker tracking and visibility tools

Access is granted on a limited, non-transferable, and revocable basis.

Restrictions

You agree not to:

  • Misuse or interfere with the platform
  • Provide false or misleading information
  • Use the platform for unlawful or unauthorized activities
  • Attempt to access restricted system areas or data

SMS Communications & Consent

By providing your phone number and opting in to receive SMS communications, you agree that AWRA Logistics may send text messages related to your use of our services.

These messages may include, but are not limited to:

  • Application and onboarding updates
  • Dispatch communications and load notifications
  • Account alerts and service-related information

Message frequency may vary. Standard message and data rates may apply.

You may opt out of SMS communications at any time by replying STOP. You may request assistance by replying HELP.

AWRA Logistics is not responsible for delays or failures in message delivery caused by carriers or third-party service providers.

You agree that SMS communications are provided as a convenience and are not guaranteed to be real-time or error-free.

User Obligations

For Drivers

Drivers leasing onto AWRA Logistics agree to:

  • check_circleMaintain a valid CDL and required endorsements
  • check_circleKeep all insurance, permits, and documents current
  • check_circleAccurately report load status and delays
  • check_circleUse ELD devices where required by law

For Brokers

Brokers using AWRA systems agree to:

  • verified_userSubmit correct rate confirmations and documentation
  • verified_userCommunicate changes or delays in a timely manner

Carrier Compliance

All drivers operating under AWRA Logistics authority must meet federal and state compliance requirements, including those set by the FMCSA.

Minimum requirements include:

  • Active and valid CDL
  • Compliance with Hours of Service (HOS) regulations
  • Active insurance coverage (liability & cargo)
  • Satisfactory safety and driving record

AWRA Logistics reserves the right to suspend or terminate access for non-compliance.

Limitation of Liability

AWRA Logistics shall not be liable for any indirect, incidental, special, or consequential damages arising from:

  • Delays in shipment or delivery
  • Loss of profits or business opportunities
  • System interruptions or platform downtime
  • Actions of third parties, including brokers or drivers

All services are provided "as is" without warranties of any kind, express or implied.

Independent Contractor Status

Drivers operating under AWRA Logistics authority are independent contractors and not employees. Nothing in these Terms shall be construed as creating an employer-employee relationship.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of VA, United States.

Any disputes arising under these Terms shall be resolved in the appropriate courts within that jurisdiction.

Payment Terms

Dispatch Fees

AWRA Logistics charges a dispatch fee calculated as a percentage of gross revenue or as a flat fee per load, as outlined in your individual service agreement.

Payment Timelines

All dispatch fees and related charges are due within the timeframe specified in your service agreement. Payments are typically processed upon receipt of freight payment from brokers or shippers.

Non-Payment Consequences

Failure to pay dispatch fees or other charges may result in suspension of services, termination of your account, and referral to collections. AWRA Logistics reserves the right to withhold loads until outstanding balances are resolved.

Termination

AWRA Logistics may suspend or terminate your access to services if:

  • False information is provided during registration or use
  • Compliance requirements are not met
  • Terms of Service are violated
  • Payment obligations are not fulfilled
  • Actions jeopardize the safety or reputation of AWRA Logistics

Either party may terminate the service agreement with written notice as specified in individual service contracts. Upon termination, all outstanding fees and obligations must be settled.

Data & Tracking Consent

By using AWRA Logistics services, users agree that AWRA Logistics may collect and use GPS and operational data for:

  • Load tracking and real-time visibility
  • Safety monitoring and compliance verification
  • Service improvement and operational efficiency
  • Customer service and support

All collected data is handled in accordance with our Privacy Policy. We do not sell personal data to third parties.

Modifications to Terms

AWRA Logistics may update these Terms at any time. We will notify users of significant changes via email or through platform notifications.

Continued use of the platform after changes are posted constitutes acceptance of updated Terms.

By using AWRA Logistics services, you acknowledge that you have read and agree to these Terms of Service.
